Former Nursing Assistant Sentenced Three Years Jail Time for Rape of Elderly Woman

A former certified nurses aide(CNA) at an elderly rehabilitation center who admitted to raping a 76-year-old patient in her room on multiple occasions was sentenced Friday to three years in prison.

The suspect, 54, pleaded guilty earlier this summer to rape of an incoherent patient and elder abuse. the District Attorney argued in favor of a six year prison sentence, but was unsuccessful.The suspect had worked at the facility for three years, and was found out only when another employee caught him in the act.

According to the officer who questioned the CNA upon his arrest, "He told me that he came in (to her room) and cleaned her up," he said. "He changed her and had sexual intercourse with her." The suspect also admitted to having had sex with the woman in May and November of 2009, the officer said. The victim was unable to confirm the occurrence, due to her advanced alzheimers and dementia.
