Jury Finds that Nursing Home Wrongfully Terminated "Whistleblower"

Earlier this week a jury found that the employee of a nursing home was wrongfully terminated after she participated in a Department of Health investigation of the facility.former employee was a respiratory therapy manager for the facility. Following a complaint to the Department of Health, the facility was cited for neglect and falsifying records.

The state investigator testified that respiratory therapy manager was the only manager that provided honest and accurate information where all of the other managers were attempting to hinder the investigation or were evasive. After the Department of Health completed its investigation, which did not involve any violations relating to the respiratory therapy department, the respiratory therapy manager was terminated.
